These Terms and Conditions govern the use of this website and the purchase of products from The Works OG (hereinafter: “we” or “Sporeworks.eu”). By accessing our website or placing an order, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
Article 1 – Validity and Definitions
The Works OG, Haidestraße 38, 1110 Vienna, Austria (hereinafter: “we” or “Sporeworks.eu”) operates an online shop on the website https://sporeworks.eu. The following Terms and Conditions apply to all services between us and our customers (hereinafter: “customer” or “you”) in the version valid at the time of the order.
“Consumer” means any natural person who concludes a legal transaction for purposes that cannot be attributed to their commercial or self-employed professional activity. “Entrepreneur” means any natural or legal person or partnership with legal capacity acting in the exercise of their commercial or professional activity.
Article 2 – Conclusion of Contract and Order Process
Our product presentations on the website are non-binding. The customer submits a binding contract offer by completing the checkout process. The order process includes selecting goods, adding them to the shopping cart, reviewing order details, entering contact and payment information, confirming these Terms and Conditions, and clicking the “Buy Now” button. A binding contract is concluded when you receive our order confirmation via email.
Before submitting the order, you can check and correct your input using the browser’s correction functions. The contract data and these Terms and Conditions will be sent to you by email after ordering. We do not store the text of the contract after completion.
Article 3 – Products and Subject of Contract
The subject matter of the contract is the sale of goods offered in our online shop. The main features of each product are described on the product pages. Any deviations in quality will be expressly noted in the product description.
Article 4 – Intended Use and Legal Compliance
All products sold by The Works OG are intended exclusively for microscopy and taxonomy purposes. By purchasing from this website, the customer confirms that they will use the products only in accordance with applicable laws and these Terms and Conditions.
Any references on this website to genus or strain names are provided for identification and informational purposes. The products offered are sold for lawful microscopy and research use only.
We offer a 30-day cleanliness guarantee ensuring that products are contamination-free at the time of delivery, subject to proper storage after receipt. We may decline or cancel orders if we reasonably believe an order may be associated with use outside the intended scope or otherwise unlawful.
Images and materials provided on this site are for educational and informational purposes. We do not provide guidance or instructions related to cultivation or propagation.
Article 5 – Prices, Payment, Shipping, and Delivery
All prices listed on the website include applicable VAT unless otherwise stated. Payment is due immediately upon order unless otherwise agreed. Accepted payment methods are displayed at checkout. Shipping costs, if applicable, are displayed prior to completing your purchase.
Unless stated otherwise, products are available for immediate dispatch after receipt of payment. Deliveries are available to the following countries: Austria, Belgium, Bulgaria, Croatia, Czech Republic, Cyprus, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, and Sweden.
Delivery to a parcel locker or package box is only available for customers in Austria. We cannot ship to parcel lockers or package boxes in other countries.
Article 6 – Right of Withdrawal
Consumers have the right to withdraw from a purchase within 14 days without giving any reason. The withdrawal period begins on the day the consumer or a third party (other than the carrier) takes possession of the goods. To exercise the right of withdrawal, notify The Works OG by email at info@sporeworks.eu. A model withdrawal form is available upon request.
Article 7 – Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received, including the cost of standard delivery (i.e., the least expensive delivery option offered by us), within 14 days from the day we receive the returned goods. Refunds will be made using the same payment method used for the original transaction, unless agreed otherwise. We may withhold the refund until the goods are received or proof of return is provided. The buyer shall bear the direct cost of returning the goods.
Article 8 – Warranty and Product Inspection
All products are inspected before shipping. The Works OG is not responsible for the customer’s handling or storage after delivery. Customers are asked to check goods immediately upon delivery for completeness or damage and to notify us promptly with photographic evidence. If goods are damaged during transport, claims should be filed with the courier and refused at delivery if visibly damaged.
Article 9 – Liability and Information Disclaimer
The Works OG shall only be liable for intent or gross negligence. Liability for indirect or consequential damages is excluded unless required by law. All information provided on this website, including articles and texts, is for educational purposes and does not guarantee outcomes or suitability for any specific purpose. We are not liable for misuse of products or unlawful use of products by the customer.
Article 10 – Data Protection
We process personal data in accordance with the EU General Data Protection Regulation (GDPR). Details are provided in our Privacy Policy available on this website.
Article 11 – Complaints and Dispute Resolution
For questions, complaints, or claims, please contact our customer service via email at info@sporeworks.eu. If disputes cannot be resolved amicably, consumers may use the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr or contact the Austrian Internet Ombudsstelle (www.ombudsstelle.at). We are not obliged nor willing to participate in consumer arbitration proceedings.
Article 12 – Contract Language
The contractual language for all transactions is English. No other language versions are available.
Article 13 – Intellectual Property
All photographs, product images, and written materials displayed on this website are copyrighted and remain the intellectual property of The Works OG or their licensors. No part of this website, including images or text, may be reproduced, copied, distributed, or used for commercial purposes without prior written consent from The Works OG. Unauthorized use will be prosecuted under applicable copyright law.
Article 14 – Final Provisions
Austrian law applies to all contracts and disputes arising from these Terms and Conditions, excluding conflict-of-law rules and the UN Sales Convention. For consumers residing in the EU, mandatory consumer protection laws of their home country remain unaffected. If the customer is a business entity, jurisdiction lies with the competent court in Vienna, Austria. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. We reserve the right to amend these Terms and Conditions; changes will be published on our website with the date of revision.
